By accessing or using Fictix, you agree to these Terms of Service and any additional terms incorporated by reference.

If you use Fictix on behalf of an organization, you represent that you have authority to bind that organization.

You must provide accurate account information and keep it current.

You are responsible for account activity, credential security, and restricting unauthorized access.

You must promptly notify us of any suspected account compromise.

You may not use Fictix to violate law, infringe rights, distribute malware, interfere with service operation, or attempt unauthorized access.

You may not use the platform to probe, scan, or test vulnerabilities without written authorization.

You may not resell or sublicense the service except as expressly allowed in a signed agreement.

You retain responsibility for data and prompts you submit, configure, or export through Fictix.

You represent that you have rights to any data you upload and that your use complies with applicable laws and contracts.

You are responsible for your downstream use of generated data and test outputs.

Paid plans are billed on the schedule shown at purchase unless otherwise stated in your order form.

Fees are non-refundable except where required by law or expressly stated in writing.

You are responsible for applicable taxes, duties, or government assessments, excluding taxes on Fictix net income.

Free trials and beta features may have limited functionality and may be modified or discontinued at any time.

Unless otherwise stated, trial use is provided without warranty and may be subject to usage limits.

Fictix and its licensors own all rights in the service, software, documentation, and branding, excluding your submitted data.

Subject to these terms, Fictix grants you a limited, non-exclusive, non-transferable right to use the service during your subscription term.

If you provide feedback, you grant Fictix a perpetual, worldwide, royalty-free right to use it to improve the service.

Fictix may integrate with third-party services. Your use of those services is governed by their terms and privacy policies.

Fictix is not responsible for third-party services, content, or acts outside our control.

Except as expressly stated in a signed agreement, Fictix is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Fictix disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Fictix will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, goodwill, or data.

To the maximum extent permitted by law, Fictix total liability for all claims related to the service will not exceed the amount paid by you to Fictix for the service during the 12 months before the event giving rise to liability.

You agree to defend, indemnify, and hold harmless Fictix and its officers, directors, employees, and affiliates from claims arising from your use of the service, your data, or your violation of these terms or applicable law.

We may suspend or terminate access if we reasonably believe your use presents security risk, legal exposure, fraud risk, or material breach of these terms.

You may stop using the service at any time, and may close your account according to product controls or by contacting support.

Sections that by their nature should survive termination will survive, including payment obligations, IP terms, disclaimers, limitations, and indemnification.

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

You agree that disputes will be resolved in the state or federal courts located in Delaware, unless a signed agreement between you and Fictix states otherwise.

We may update these terms from time to time. Updated terms become effective when posted unless otherwise stated.

If changes are material, we will provide reasonable notice through the service or by email.
